ADA Reasonable Accommodation Issues

in the Age of COVID-19

Program Description: 

David K. Fram, a nationally renowned subject matter expert on the Americans with Disabilities Act (ADA), will share his insight and perspective on a wide variety of reasonable accommodation issues that have arisen during the COVID-19 pandemic. David's interactive session will focus on the following:

  • Update on COVID-19 reasonable accommodation issues, including specific questions of work-at-home, leave, protective equipment, and vaccination requirements.
  • Discussion of the latest cases on practical reasonable accommodation issues, including critical new cases on the meaning of "reasonable," what technically triggers the duty to interact, when accommodations are and are not required, whether an employer will be “punished” for doing a “good deed” by providing more than might have been required by the law (including allowing employees to work at home because of COVID safety issues), and particular accommodation requests such as leave (including repeated leave extensions), schedule adjustments, change of supervisors, non-competitive reassignment, shift changes, and a perfume-free workplace.

SPEAKERS BIO:


David K. Fram, Esq. 
Director of ADA & EEO Services
for the National Employment Law Institute (NELI).  

In this position, he conducts seminars, briefings, workshops, and in-house training on the ADA and other EEO laws.  He also provides guidance, as well as expert witness services, during administrative proceedings and litigation.

From 1991-1996, David was Policy Attorney in the Office of Legal Counsel of the Equal Employment Opportunity Commission (EEOC) in Washington, D.C.  This office formulates regulations and policy on federal EEO laws.  Before this, David was an attorney with the firm of Hogan & Hartson in Washington, D.C. where he represented employers in a broad range of employment issues.

Since joining NELI in 1996, David has spoken extensively around the country concerning ADA and EEO compliance issues, including testifying before Congress about the ADA and proposed changes to the law.  He has trained thousands of HR professionals, attorneys, and others representing manufacturers, federal, state and local governments, colleges and universities, hospitals and health service providers, benefit providers, non-profits, and law firms and bar associations, among others.  He also has trained hundreds of EEOC investigators and EEOC attorneys who analyze and resolve ADA claims.  In addition, David has consulted with EEOC investigators and EEOC attorneys during the investigation and resolution of all forms of discrimination complaints.
